WHEREAS, pursuant to the terms of the participation agreement, attached hereto as Exhibit 1, Urban Housing Solutions ("UHS"), in compliance with all Metropolitan Government of Nashville and Davidson County ("Metro") requirements and specifications, will contract and oversee the construction of enhanced pedestrian signaling, including a HAWK signal, at 2940 Dickerson Pike, to serve its development at The Skyliner; and,
WHEREAS, Metro will inspect the construction and upon acceptance, will be responsible for ongoing operation and maintenance; and,
WHEREAS, Metro agrees to pay $85,225.25 as a contribution toward these improvements; and
WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this ordinance be approved.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The participation agreement (Exhibit 1) between the Metropolitan Government of Nashville and Davidson County, acting by and through the Housing Division of the Metropolitan Planning Department, and Urban Housing Solutions to enhance pedestrian signaling, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. Eighty-Five Thousand Two Hundred and Twenty-Five Dollars and Twenty-Five Cents ($85,225.25) from Metro is available in Funds No. 40021 and 40022 are available as a contribution to toward the Project.
Section 3. Amendments to this legislation shall be approved by resolution.
