An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon public sanitary sewer mains, sanitary sewer manholes and an easement, to construct public sanitary sewer mains and sanitary sewer manholes, and to acquire permanent and temporary easements through negotiation and acceptance, needed for property located at 28th Avenue North (unnumbered) (Project No. 22-SG-06 and Proposal No. 2022M-154ES-001).

WHEREAS, the abandonment of approximately 670 linear feet of existing 12 inch sanitary sewer main, two sanitary sewer manholes and easement, and the construction of approximately 660 linear feet of new 12 inch sanitary sewer mains (DIP) and five sanitary sewer manholes, for property located at 28th Avenue North (unnumbered), are needed to construct Project No. 22-SG-06; and,
WHEREAS, the negotiation and acceptance of permanent and temporary easements, for property located at 28th Avenue North (unnumbered), are also needed to construct Project No. 22-SG-06; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-154ES-001 on October 13, 2022, for the abandonment and construction of said sanitary sewer mains and sanitary sewer manholes and for the negotiation and acceptance of temporary and permanent easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 670 linear feet of existing 12 inch sanitary sewer main, two sanitary sewer manholes and easement, to construct approximately 660 linear feet of new 12 inch sanitary sewer mains (DIP) and five sanitary sewer manholes, and to negotiate and accept permanent and temporary easements, for property located at 28th Avenue North (unnumbered), as shown on Exhibit 1, which is attached hereto and incorporated by reference.
