WHEREAS, certain routes in the Metropolitan Government of Nashville and Davidson County (“Metro”) have been designated as eligible for Federal and State Aid Funds; and,
WHEREAS, the Tennessee Department of Transportation (TDOT) will provide safety improvements to State Route 45 (Old Hickory Boulevard) at Myatt Drive; and,
WHEREAS, in exchange for all safety improvements, Metro will cooperate with TDOT during the installation and upon completion of the improvements, accept and maintain the improvements per Agreement 220127, attached hereto as Exhibit A; and,
WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the intergovernmental agreement by and between the State of Tennessee, Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Department of Transportation and Multimodal Infrastructure, for the maintenance of safety improvements under Agreement No. 220127, a copy of which is attached hereto as Exhibit A and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.
Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves an intergovernmental agreement between the Tennessee Department of Transportation (“TDOT”) and the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”) for maintenance of State Route 45 (Old Hickory Boulevard) at Myatt Drive. Pursuant to the agreement, TDOT will pay for the construction services provided and NDOT will pay for the maintenance and operating costs of the maintenance.
Fiscal Note: There is no cost to Metro for the performance of this agreement. Metro would be responsible for the maintenance upon completion and acceptance of the safety improvements on State Route 45 (Old Hickory Boulevard) at Myatt Drive.
