WHEREAS, the Metropolitan Government of Nashville and Davidson County, acting through its Department of Parks and Recreation, desires to enter into a license agreement with the State of Tennessee Department of Transportation to use a portion of the Licensed Premises described in Exhibit A attached hereto, to construct and maintain a multi-use pedestrian greenway in Davidson County, Tennessee; and,

WHEREAS, the license agreement is attached hereto and incorporated herein; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that the license agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                      The license agreement between The Metropolitan Government of Nashville and Davidson County, by and through the Department of Parks and Recreation, and the State of Tennessee, acting by and through its Commissioner of Transportation, a copy of which is attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

Section 2.                     That any amendments, renewals or extensions of the terms of the license agreement shall be approved by Resolution of the Metropolitan Council receiving at least twenty-one affirmative votes.

Section 3.                      This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves a license agreement between the Metropolitan Department of Parks and Recreation (“Parks”) and the Tennessee Department of Transportation (“TDOT”). Pursuant to the agreement, Parks would use a portion of State Route 155 right-of-way adjacent to the ramp to Two Rivers Parkway and Gaylord Drive to install and maintain a multi-modal greenway project to be known as the “Stones River Greenway - Opry Mills Greenway Connector”. TDOT would permit the use of this property for this purpose. Parks would not pay for the use of this license, however Parks will be responsible for the maintenance and operation of the improvements. The term of the license agreement is 20 years.

 

Amendments, renewals, or extensions of the terms of the license agreement may be approved by a resolution of the Council receiving at least 21 affirmative votes.

 

This has been approved by the Planning Commission.

 

Fiscal Note: There is no cost to Metro for the performance of this agreement.
