title

A Resolution requesting the Department of Codes Administration to issue a monthly report to Council regarding codes enforcement after regular business hours.

body

WHEREAS, the Metropolitan Department of Codes Administration currently sends out a team of codes inspectors to enforce nighttime violations after regular business hours about once a month; and

WHEREAS, this nighttime enforcement team is important as they are able to enforce violations that occur after regular business hours that cannot otherwise be enforced the next day, such as complaints about the brightness of lights from homes or businesses, illegal businesses, and parking on grass; and

WHEREAS, the population of Nashville and Davidson County has increased significantly according to the 2020 Census and codes violations are often sent to HUB Nashville afterhours. These violations are left to be enforced by the Fire Department and the Metropolitan Nashville Police Department; and

WHEREAS, it is important to understand how Codes can better enforce codes violations. Better understanding the effectiveness of the current monthly afterhours enforcement by codes inspectors will assist with better addressing constituent complaints.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Council requests the Metropolitan Department of Codes Administration provide a monthly reporting for certain complaints received after regular business hours by the Codes Department each month. The report should include information on complaints for activities that would be enforced by the nighttime codes inspector teams, including but not limited to complaints about lighting, illegal businesses, parking on grass, and any other night violations that cannot be followed-up on the next day. This reporting should begin August 1, 2022, and be provided each month until February 2023. The report should be provided to the Council in a spreadsheet and contain the following information:

1.                     The complaint number;

2.                     The address of the complaint;

3.                     Date of the complaint;

4.                     Date of the inspection of the complaint;

5.                     Status of the complaint (completed, unresolved, etc.); and

6.                     If completed, date that the complaint was closed as completed.

Section 2. The Metropolitan Clerk is directed to provide a copy of this resolution to the Metropolitan Department of Codes Administration.

Section 3. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
