WHEREAS, Tennessee Code Annotated § 68-120-101 allows local governments to adopt either the International Fire Code, published by the International Code Council, Inc., or the NFPA 1 Fire Code, published by the National Fire Protection Association, Inc., provided the local government certifies to the state fire marshal that it is adequately enforcing such code; and,

WHEREAS, pursuant to BL2021-658, the Metropolitan Government adopted the 2018 edition of the NFPA 1 Fire Code, as amended, published by the National Fire Protection Association; and,

WHEREAS, the applicable codes for fire, building, dwelling, energy, gas/mechanical, plumbing, and life safety standards are updated by international bodies on a periodic basis; and,

WHEREAS, such updates are adopted by the Metropolitan Council into the Metropolitan Code of Laws as the governing standards for Davidson County, Tennessee; and,

WHEREAS, the amendments of these sections of the Metropolitan Code, the NFPA 101 Life Safety Code, and the NFPA 1 Fire Code are in the best interest of the citizens of Nashville and Davidson County.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That Section 10.64.010 of the Metropolitan Code is hereby amended by adding “and the NFPA 101 Life Safety Code” following the phrase “the NFPA 1 Fire Code” in the first sentence. 

Section 2.                     That Section 10.64.010 of the Metropolitan Code is hereby amended by adding the following sentence at the end of the section: “A copy of the NFPA 101 Life Safety Code is codified in this section, as amended, as if copied verbatim herein.”

Section 3.                     That Section 13.3.5.1 of the NFPA 101 Life Safety Code is hereby amended by deleting and substituting the following:

Where the occupant load exceeds 200, the following assembly occupancies shall be protected throughout by an approved, supervised automatic sprinkler system in accordance with 9.7 where the exhibition or display area exceeds 15,000 ft2 (1400m2)

Nightclubs

Assembly occupancies with festival seating

 

Section 4.                       A copy of the NFPA 101 Life Safety Code is on file with the Nashville Fire Department and the Metropolitan Clerk’s Office and codified in Section 10.64.010, as amended, as if copied verbatim herein.

Section 5.                     That Section 18.5.5.1 of the NFPA 1 Fire Code is hereby amended by deleting and substituting the following:

Private water supply systems shall be tested and maintained in accordance with NFPA 25 and Table 7.1.1.2, except private fire hydrants shall be tested semiannually.

Section 6.                      That Section 10.64.012 of the Metropolitan Code is hereby amended by deleting subsections A, P, and T, in their entirety and replacing them with the following:

                     Section 1.7.3 is amended by adding the following subsection:

1.7.3.3 Except for the provisions listed in Chapter 18; the provisions of this code do not apply to one and two-family dwellings and the construction, normal use or maintenance thereof. 

P. Section 18.5.2 Detached One- and Two-family Dwellings, subsection (1) is amended by deleting “600 ft. (183 m)” and substituting “ 500 ft. (152 m)”, and adding exception 1.: Exception 1: A Detached One- and Two-family Dwelling located on a parcel of five acres or larger shall be exempt from the 500 ft. distance to a fire hydrant provided the closest fire hydrant is capable of supplying the minimum required fire flow rate, or, equipped with an automatic sprinkler system in accordance with NFPA 13D, or an approved alternative fire department water supply is provided.

T. NFPA 101, Life Safety Code, 2018 edition, incorporated by reference in chapter 2 of the 2018 edition of NFPA 1 is amended in the following respects: Chapter 24 is deleted except where specifically referenced.

Section 7.                      That Section 10.64.012 of the Metropolitan Code is hereby amended by adding the following subsection:

U. Section 18.4.5.1 is amended by adding a new sub section. 18.4.5.1.1 The minimum required fire flow for townhouse buildings containing between three and eight dwellings not exceeding 3600 square feet shall be 1000 gpm for 1 hour duration where a 2-hour fire rated demising wall, without penetrations, extends from the foundation to the roof deck. 

Section 8.                     This Ordinance shall take effect immediately after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance amends Chapter 10.64 of the Metropolitan Code of Laws to update the NFPA Fire Code. The Council adopted the 2018 edition of the National Fire Protection Association (“NFPA”) 1 Fire Code pursuant to Ordinance No. BL2021-658. The applicable codes for fire, building, dwelling, energy, gas/mechanical, plumbing, and life safety standards are updated by international bodies on a periodic basis, and such updates are currently available.

 

This ordinance amends the Metropolitan Code to add references to the NFPA 101 Life Safety Code, which will be on file with the Nashville Fire Department and the Metropolitan Clerk’s Office. The ordinance also amends provisions of the NFPA 101 Life Safety Code and the NFPA 1 Fire Code.
