A resolution approving an interlocal agreement between the Emergency Communications District for Nashville and Davidson County and The Metropolitan Government of Nashville and Davidson County for the provision of services and reimbursement of costs pertaining to Enhanced-911 services.

WHEREAS, the Emergency Communications District for Metropolitan Nashville and Davidson County (“Emergency Communications District”) was created by Ordinance No. 088-609; and,
WHEREAS, the Emergency Communications District has the powers of a municipality under Tennessee law by virtue of Tennessee Code Annotated section 7-86-106; and,
WHEREAS, the Metropolitan Government seeks to enter into an agreement with the Emergency Communications District whereby Enhanced-911 services will be provided for the area of the Metropolitan Government for the 2022-2023 fiscal year; and,
WHEREAS, under the agreement, the Metropolitan Government will provide certain services to the Emergency Communications District for the 2022-2023 fiscal year; and,
WHEREAS, under the agreement, the Emergency Communications District will reimburse the Metropolitan Government for certain costs; and,
WHEREAS, Tennessee Code Annotated Section 12-9-101, et seq., grants political subdivisions of Tennessee the authority to enter into interlocal agreements to operate common projects and achieve common objectives subject to the approval of their respective governing bodies or otherwise as provided by law; and,
WHEREAS, it is in the best interest of the Metropolitan Government that the agreement be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the agreement between The Metropolitan Government of Nashville and Davidson County and the Emergency Communications District for Metropolitan Nashville and Davidson County for the provision of Enhanced-911 services and reimbursement of costs for the 2022-2023 fiscal year, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan County Mayor is authorized to execute the same on behalf of the Metropolitan Government.
Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves an interlocal agreement between the Emergency Communications District for Nashville and Davidson County (ECD) and the Metropolitan Government for the provision of services and reimbursement of costs pertaining to Enhanced-911 services.
Pursuant to this agreement, Department of Emergency Communications (DEC) agrees to operate the Enhanced-911 emergency communications systems and services provided by ECD. Through the Nashville Department of Transportation (NDOT), Metro will update the AT&T Master Street Address Guide database and notify AT&T of all changes to existing street names and building numbers in the Metro area. Through the Department of General Services, Metro will also provide vehicles for use by DEC. ECD will pay Metro $4,900 for the services provided by NDOT as well as reimbursement for training, a DEC back-up facility, telephone services at the back-up facility, and fleet expenses. The term of the agreement begins July 1, 2022 and ends on June 30, 2023. Either party may terminate this agreement at an earlier date upon 30 days written notice.
Fiscal Note: Emergency Communication District (ECD) will pay Metro in the amount of $4,900 for services provided to ECD by the Department of Transportation from July 1, 2022 through June 30, 2023. ECD will reimburse Metro for training, rental, telephone, fleet and other expenses used in the provision of 911 service.
