WHEREAS, the abandonment of approximately 47 linear feet of existing 10 inch water main (DIP), approximately 75 linear feet of existing 16 inch water main (DIP), approximately 210 linear feet of existing 87 inch combination sewer main (brick), approximately 151 linear feet of existing eight feet by eight feet combination sewer main (RCBC), two combination sewer manholes and easements, the relocation of one fire hydrant assembly, and the acceptance of approximately 71 linear feet of new 10 inch water main (DIP), approximately 87 linear feet of new 16 inch water main (DIP), approximately 347 linear feet of new eight feet by eight feet combination sewer main (RCBC), four combination sewer manholes and easements, for two properties located at 2600 Jess Neely Drive and 2555 West End Avenue, also known as Vanderbilt Athletics Phase 1, are needed to construct project numbers 22-WL-36 and 22-SL-82; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-087ES-001 on June 10, 2022, for the abandonment, relocation, and acceptance of said water and combination sewer mains, fire hydrant assembly, combination sewer manholes and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 47 linear feet of existing 10 inch water main (DIP), approximately 75 linear feet of existing 16 inch water main (DIP), approximately 210 linear feet of existing 87 inch combination sewer main (brick), approximately 151 linear feet of existing eight feet by eight feet combination sewer main (RCBC), two combination sewer manholes and easements, to relocate one fire hydrant assembly, and to accept approximately 71 linear feet of new 10 inch water main (DIP), approximately 87 linear feet of new 16 inch water main (DIP), approximately 347 linear feet of new eight feet by eight feet combination sewer main (RCBC), four combination sewer manholes and easements, for two properties located at 2600 Jess Neely Drive and 2555 West End Avenue, also known as Vanderbilt Athletics Phase 1 , as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment, relocation and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation hall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance has been approved by the Planning Commission. Future amendments to this ordinance may be approved by resolution.

 

Fiscal Note: This ordinance has no cost to Metro. Donated and abandoned easements have no market value according to the Department of Water Services.
