WHEREAS, Ordinance No. BL2020-353, approved August 5, 2020, and amended by Resolution No. RS2021-799, approved March 3, 2021, authorized the abandonment of approximately 222 linear feet of existing 15 inch sanitary sewer main (PVC) and easements, and the acceptance of approximately 290 linear feet of new 18 inch sanitary sewer main (PVC), five sanitary sewer manholes, a fire hydrant assembly and easements, for property located at 810 Division Street; and,

WHEREAS, the acceptance of an additional fire hydrant assembly is needed to construct Project No. 20-WL-139; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-078ES-001 on May 23, 2022, for the acceptance of said additional public fire hydrant assembly; and,

WHEREAS, Ordinance No. BL2020-353 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     That Ordinance No. BL2020-353 is hereby amended by deleting Section 1 in its entirety and replacing it with the following:

The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 222 linear feet of existing 15 inch sanitary sewer main (PVC) and easements, and to accept 290 linear feet of new 18 inch sanitary sewer main (PVC), five sanitary sewer manholes, two fire hydrant assemblies and easements, for property located at 810 Division Street, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution amends Ordinance No. BL2020-353 to accept an additional fire hydrant assembly for property located at 810 Division Street. BL2020-353, as amended by Resolution No. RS2021-799, abandoned 222 linear feet of existing 15-inch sanitary sewer main and easements, and accepted 290 linear feet of new 18-inch sanitary sewer main, five sanitary sewer manholes, a fire hydrant assembly, and easements for this property. It has since been determined that one additional fire hydrant assembly is needed for the project.

 

This ordinance has been approved by the planning commission. BL2020-353 provided that future amendments to this ordinance may be approved by resolution.

 

Fiscal Note: This ordinance has no cost to Metro. Donated easements have no market value according to the Department of Metro Water Services.
