An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent easements for the Jacksons Valley Road Stormwater Improvement Project for six properties located on Jacksons Valley Road, (Project No. 22-SWC-196 and Proposal No. 2022M-073ES-001).

WHEREAS, the negotiation and acceptance of permanent easements for six properties located on Jacksons Valley Road are needed to construct MWS Project 22-SWC-196; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-073ES-001 on May 9, 2022, for the negotiation and acceptance of permanent easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept permanent easements for six properties located on Jacksons Valley Road, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.
Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations and acceptance authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Fiscal Note: This ordinance has no cost to Metro. Donated easements have no market value according to the Department of Metro Water Services.
