WHEREAS, the abandonment of approximately 250 linear feet of existing eight inch sanitary sewer main (VCP) and one sanitary sewer manhole, and the rehabilitation of approximately 175 linear feet of existing eight inch sanitary sewer main (VCP) with inner pipe lining and two sanitary sewer manholes, for eight properties located at Lebanon Pike, Rucker Avenue, and White Avenue, are needed to construct project number 21-SL-238; and,

WHEREAS, Ordinance No. BL2021-649, approved March 16, 2021, authorized the amendment of the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning Alley Number 2058 right-of-way south of Lebanon Pike and east of Rucker Avenue and retaining existing easement rights; and,

WHEREAS, the easement rights that were retained by Council Bill BL2021-649, for any existing utilities located at former Alley Number 2058, are no longer needed; and,

WHEREAS, the abandonment has been requested by Development Management Group on behalf of the owner; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-072ES-001 on April 29, 2022, for the abandonment and the rehabilitation of said sanitary sewer mains, sanitary sewer manholes, and easement rights.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 250 linear feet of existing eight inch sanitary sewer main (VCP) and one sanitary sewer manhole and easement rights that were retained by Ordinance BL2021-649 for any existing utilities located at former Alley Number 2058, and to rehabilitate approximately 175 linear feet of existing eight inch sanitary sewer main (VCP) with inner pipe lining and two sanitary sewer manholes, for eight properties located at Lebanon Pike, Rucker Avenue, and White Avenue, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and the rehabilitation authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance has been approved by the Planning Commission. Future amendments to this ordinance may be approved by resolution.

 

Fiscal Note: This ordinance has no cost to Metro. Abandoned easements have no market value according to the Department of Metro Water Services.
