WHEREAS, the abandonment of approximately 222 linear feet of existing public eight inch water main and easement, the relocation of one public fire hydrant assembly, and the acceptance of a permanent easement, for property located at 433 Opry Mills Drive, also known as Olive Garden restaurant, are needed to construct project number 21-WL-120; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-053ES-001 on April 5, 2022, for the abandonment of said water main and easement, relocation of a fire hydrant assembly, and acceptance of said permanent easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 222 linear feet of existing public eight inch water main and easement, to relocate one public fire hydrant assembly, and to accept a permanent easement, for property located at 433 Opry Mills Drive, also known as Olive Garden restaurant, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment, relocation and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
