WHEREAS, the abandonment of approximately 192 linear feet of existing eight inch sanitary sewer main (PVC) and one sanitary sewer manhole, and the acceptance of approximately 142 linear feet of new eight inch sanitary sewer main (DIP), approximately 35 linear feet of new eight inch sanitary sewer main (PVC) and two sanitary sewer manholes, for three properties located at 1170, 1176 and 1180 Dickerson Pike, also known as Dickerson Pike Townhomes, are needed to construct project number 21-SL-230; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-009ES-001 on January 10, 2022, for the abandonment and acceptance of said sanitary sewer mains and sanitary sewer manholes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 192 linear feet of existing eight inch sanitary sewer main (PVC) and one sanitary sewer manhole, and to accept approximately 142 linear feet of new eight inch sanitary sewer main (DIP), approximately 35 linear feet of new eight inch sanitary sewer main (PVC) and two sanitary sewer manholes, for three properties located at 1170, 1176, and 1180 Dickerson Pike, also known as Dickerson Pike Townhomes, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Fiscal Note: This ordinance has no cost to Metro. Abandoned and donated easements have no market value according to the Department of Water Services.
