WHEREAS, the abandonment of approximately 204 linear feet of existing 10 inch sanitary sewer main, three sanitary sewer manholes, one fire hydrant assembly and easements, and the acceptance of one sanitary sewer manhole, one fire hydrant assembly and easements, for property located at 1207 McGavock Street, also known as Gulch Union South Tower, are needed to construct project numbers 21-SL-135 and 21-WL-57; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2022M-001ES-001 on November 30, 2021, for the abandonment and acceptance of said sanitary sewer main, sanitary sewer manholes, fire hydrant assemblies and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 204 linear feet of existing 10 inch sanitary sewer main, three sanitary sewer manholes, one fire hydrant assembly and easements, and to accept one sanitary sewer manhole, one fire hydrant assembly and easements, for property located at located at 1207 McGavock Street, also known as Gulch Union South Tower, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
