WHEREAS, pursuant to the authority of Section 17.40.750(A) of the Metropolitan Code of Laws, the Zoning Administrator has developed for the Metropolitan Council's consideration a fee schedule associated with the processing and review of appeals made to the Short Term Rental Appeals Board ("the Board"); and,
WHEREAS, the cost of the time spent by the Codes Department staff to process and review appeals for consideration by the Board is currently borne by Metro taxpayers, and it is in the best interest of the Metropolitan Government to instead collect that cost from the persons and companies most directly benefitted by the appeals permit issuance.
WHEREAS, pursuant to Section 17.40.740 of the Metropolitan Code of Laws, the adoption of a new fee schedule may be accomplished by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the fee listed in the attached Exhibit A "Metropolitan Government Fee Schedule for the Board" is hereby established as the fee for such applications.
Section 2. That, upon adoption, this fee schedule shall be kept on file and made available to the public at the Metropolitan Clerk's office and the Metropolitan Department of Codes and Building Safety.
Section 3. That this resolution shall take effect after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
