WHEREAS, the State of Tennessee ("STATE") is constructing the Tennessee State Library and Archives ("TSLA") building and designing the TSLA to discharge stormwater into the combined sewer system in a manner that is in accordance with current standards; and,
WHEREAS, the Metropolitan Department of Water and Sewerage Services ("METRO") instead desires to have the TSLA stormwater discharged into a dedicated storm system that currently exists, but that requires upgrades due to capacity limitations and increased additional flow from the TLSA site, as shown in Exhibit 1 hereto attached; and,
WHEREAS, STATE agrees to provide METRO the amount of $515,415.00 to fund the upgrades, including design and construction of the current and new stormwater systems, in accordance with the terms of the Intergovernmental Participation Agreement, attached as Exhibit 1; and,
WHEREAS, STATE and METRO agree that any unused portion of the payment for design and construction costs shall be refunded to the STATE; and,
WHEREAS, METRO agrees to begin design and construction of the project within timeframes set forth by Metro Water Services upon receiving the funds; and,
WHEREAS, the provision of such storm sewer service improvement is deemed to benefit both parties and the general community.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.
