A resolution to amend Ordinance No. BL2021-684 to authorize The Metropolitan Government of Nashville and Davidson County to abandon water main, fire hydrant assemblies, and easements, to add phasing, to modify the acceptance of new public sanitary sewer and water main, sanitary sewer manholes, fire hydrant assemblies and easements, and update Map and Parcel information, for property now located at 1320 Adams Street, now known as the Neuhoff Development Phase 1 (MWS Project Nos. 20-WL-35 and 20-SL-70 and Proposal No. 2021M-010ES-002).

WHEREAS, Ordinance No. BL2021-684, approved April 21, 2021, authorized the acceptance of approximately 607 linear feet of new 12 inch water main (DIP), approximately 948 linear feet of new eight inch sanitary sewer main (PVC), four fire hydrant assemblies, 10 sanitary sewer manholes and easements, for eight properties located on Adams Street, Taylor Street and 1st Avenue North, also known as the Neuhoff Development; and,
WHEREAS, the abandonment of approximately 670 linear feet of 12 inch water main, two fire hydrant assemblies and easements, is needed to construct Project No. 20-WL-35; and,
WHEREAS, Project Nos. 20-WL-35 and 20-SL-70 now refer to Neuhoff Development Phase 1; and,
WHEREAS, the previous approved acceptance includes approximately 411 linear feet of new 12 inch water main (DIP), approximately 376 linear feet of new eight inch sanitary sewer main (PVC), three fire hydrant assemblies, four sanitary sewer manholes and easements, for property now located at 1320 Adams Street, that are no longer needed to construct Project Nos. 20-WL-35 and 20-SL-70; and,
WHEREAS, the eight properties located on Adams Street, Taylor Street and 1st Avenue North, are now one property located at 1320 Adams Street; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2021M-010ES-002 on June 2, 2021, for the abandonment of water main, fire hydrant assemblies, and easements, the addition of phasing, and the modification of the acceptance of new public water and sanitary sewer main, fire hydrant assemblies. sanitary sewer manholes and easements; and,
WHEREAS, Ordinance No. BL2021-684 provides that amendments to the legislation shall be approved by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Ordinance No. BL2021-684 is hereby amended by deleting Section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 670 linear feet of existing 12 inch water main, two fire hydrant assemblies and easements, and to accept approximately 196 linear feet of new 12 inch water main (DIP), approximately 572 linear feet of new eight inch sanitary sewer main (PVC), one fire hydrant assembly, six sanitary sewer manholes and easements, for property located at 1320 Adams Street, also known as Neuhoff Development Phase 1, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.
Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Ordinance No. BL2021-684, enacted on April 20, 2021, accepted new water and sewer main, fire hydrant assemblies, sewer manholes, and associated easements for eight properties located on Adams Street, Taylor Street, and 1st Avenue North, also known as the Neuhoff Development. These properties have now been consolidated with a new address of 1320 Adams Street. It has been determined that abandonment of 670 linear feet of existing 12 inch water main, two fire hydrants, and easements are necessary for the development.
This resolution amends the prior ordinance to accomplish this abandonment. Ordinance No. BL2021-684 provided that future amendments can be approved by resolution.
This resolution has been approved by the Planning Commission.
Fiscal Note: This ordinance has no cost to Metro. Abandoned and donated easements have no market value according to the Department of Water Services.
