WHEREAS, easement rights for an existing drainage easement conveyed unto The Metropolitan Government of Nashville and Davidson County in Deed Book 8784, Page 395, R.O.D.C., TN (Davidson County Register of Deeds), for property located at 338 East Trinity Lane, are no longer needed; and,

WHEREAS, the abandonment has been requested by the owner; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2021M-038ES-001 on April 26, 2021, for the abandonment of said drainage easement rights.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon easement rights for an existing drainage easement conveyed unto The Metropolitan Government of Nashville and Davidson County in Deed Book 8784, Page 395, R.O.D.C., TN (Davidson County Register of Deeds), for property located at 338 East Trinity Lane, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance abandons a drainage easement for property located at 338 East Trinity Lane. This easement is no longer needed by Metro Water Services. Future amendments to this ordinance may be approved by resolution.

 

This ordinance has been approved by the Planning Commission.

 

Fiscal Note: There is no cost to Metro. Abandoned and donated easements have no market value according to the Department of Water Services.
