A resolution to amend Ordinance No. BL2015-9 to authorize The Metropolitan Government of Nashville and Davidson County to abandon a sewer pumping station building and associated easement, to retain the remaining Public Utility & Drainage Easements, and correct and update Map and Parcel information, for properties located at 4872 Myra Drive, Tulip Grove (unnumbered) and Colchester Drive (unnumbered) (MWS Project No. 15-SL-184 and Proposal No. 2015M-046ES-002).

WHEREAS, Ordinance No. BL2015-9, approved November 5, 2015, authorized the abandonment of approximately 82 linear feet of existing eight inch sewer main and 1,341 linear feet of six inch sewer force main, the existing Farmingham Woods Pumping Station, and easements, and the acceptance of the following sanitary sewer mains: 213 linear feet of 15 inch DIP, 1,414 linear feet of 15 inch PVC, 82 linear feet of 12 inch DIP, 20 linear feet of 12 inch PVC, and 39 linear feet of eight inch PVC for property located at Tulip Grove Road (unnumbered); and,
WHEREAS, the sewer pumping station building and associated easement, for property located at Colchester Drive (unnumbered), are no longer needed; and,
WHEREAS, the remaining Public Utility & Drainage Easements, as shown in Plat Book 7900, Page 306, Davidson County Register of Deeds, will be retained; and,
WHEREAS, the abandonment of the building has been requested by Farmingham Woods Homeowners Association, Inc., owner; and,
WHEREAS, upon final approval of this Resolution, the attached Release will be Recorded indicating ownership of the sewer pumping station building is transferred to Colchester Drive (unnumbered); and,
WHEREAS, the Map and Parcel information provided in BL2015-9 for properties located at 4872 Myra Drive and Tulip Grove (unnumbered), was incorrect; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2015M-046ES-002 on April 15, 2021, for the abandonment of said sewer pumping station building and associated easement, and the retention of the remaining Public Utility & Drainage Easements; and,
WHEREAS, Ordinance No. BL2015-9 provides that amendments to the legislation shall be approved by resolution.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Ordinance No BL2015-9 is hereby amended by deleting Section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 82 linear feet of existing eight inch sewer main and approximately 1,341 linear feet of six inch sewer force main, the existing Farmingham Woods Pumping Station and building and associated easements, to retain the remaining Public Utility & Drainage Easements, and to accept approximately 213 linear feet of new 15 inch sanitary sewer main (DIP), approximately 1,414 linear feet of new 15 inch sanitary sewer main (PVC), approximately 82 linear feet of new 12 inch sanitary sewer main (DIP), approximately 20 linear feet of new 12 inch sanitary sewer main (PVC), approximately 39 linear feet of new eight inch sanitary sewer main (PVC), 7 sanitary sewer manholes and easements, for property located at located at 4872 Myra Drive, Tulip Grove (unnumbered), and Colchester Drive (unnumbered), as shown below and on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.
Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution approves an amendment to Ordinance No. BL2015-9 to abandon a sewer pump station and associated easement for property located at Colchester Drive (unnumbered). Ordinance No. BL2015-9 abandoned various sections of sewer main and easements, as well as the existing Farmingham Woods pumping station, and accepted replacement sewer mains. The ordinance provided that future amendments may be approved by resolution. It has been determined that the Colchester Drive sewer pumping station building and easements are no longer needed by Metro and can also be abandoned. This abandonment has been requested by the Farmington Woods Homeowners Association.
This resolution has been approved by the Planning Commission.
