WHEREAS, Ordinance No. BL2019-1714, approved July 17, 2019, authorized the abandonment of approximately 198 linear feet of existing six inch water main (cast iron), approximately 390 linear feet of existing six inch water main (DIP), and one fire hydrant assembly, and the acceptance of approximately 248 linear feet of new 12 inch water main (DIP) and one fire hydrant assembly, for property located at 2501 Clifton Avenue; and,
WHEREAS, the abandonment of existing utility easement rights, retained by Ordinance No. BL2018-1250, approved July 18, 2018, is needed to construct project number 18-WL-55; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M-048ES-002 on April 7, 2021, for the abandonment of said utility easement rights; and,
WHEREAS, Ordinance No. BL2019-1714 provides that amendments to the legislation shall be approved by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Ordinance No. BL2019-1714 is hereby amended by deleting section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 198 linear feet of existing six inch water main (cast iron), approximately 390 linear feet of existing six inch water main (DIP), one fire hydrant assembly and easements, and to accept approximately 248 linear feet of new 12 inch water main (DIP) and one fire hydrant assembly, for property located at 2501 Clifton Avenue, as shown on Exhibit 1, which is attached hereto and incorporated by reference.
