WHEREAS, the abandonment of approximately 95 linear feet of existing eight inch sanitary sewer main and easements, and the acceptance of approximately 555 linear feet of new eight inch sanitary sewer main (PVC), approximately 175 linear feet of new eight inch sanitary sewer main (DIP), approximately 194 linear feet of new four inch water main (DIP), approximately 351 linear feet of new six inch water main (DIP), approximately 288 linear feet of new eight inch water main (DIP), seven sanitary sewer manholes, one fire hydrant assembly and easements, for property located at 3449 Brick Church Pike, also known as Village By The Creek Section 10B, are needed to construct project numbers 20-SL-228 and 20-WL-117; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2021M-029ES-001 on April 7, 2021, for the abandonment and acceptance of said sanitary sewer and water mains, sanitary sewer manholes, fire hydrant assembly, and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 95 linear feet of existing eight inch sanitary sewer main and easements, and to accept approximately 555 linear feet of new eight inch sanitary sewer main (PVC), approximately 175 linear feet of new eight inch sanitary sewer main (DIP), approximately 194 linear feet of new four inch water main (DIP), approximately 351 linear feet of new six inch water main (DIP), approximately 288 linear feet of new eight inch water main (DIP), seven sanitary sewer manholes, one fire hydrant assembly and easements, for property located at 3449 Brick Church Pike, also known as Village By The Creek Section 10B, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This ordinance abandons eight inch sewer main and easements, and accepts replacement sewer and water mains, sewer manholes, one fire hydrant assembly, and easements for property located at 3449 Brick Church Pike, known as Village By The Creek Section 10B. Future amendments to this ordinance may be approved by resolution.

 

This ordinance has been approved by the Planning Commission.

 

Fiscal Note: There is no cost to Metro. Abandoned and donated easements have no market value according to the Department of Water Services.
