A resolution to amend Ordinance No. BL2020-353 to authorize The Metropolitan Government of Nashville and Davidson County to accept additional sanitary sewer manholes and a fire hydrant assembly, for property located at 810 Division Street (MWS Project Nos. 20-SL-59 and 20-WL-139 and Proposal No. 2020M-044ES-002).

WHEREAS, Ordinance No. BL2020-353, approved August 5, 2020, authorized the abandonment of approximately 222 linear feet of existing 15 inch sanitary sewer main (PVC) and easements, and the acceptance of approximately 290 linear feet of 18 inch sanitary sewer main (PVC), three sanitary sewer manholes and easements for property located at 810 Division Street; and,
WHEREAS, the acceptance of two additional sanitary sewer manholes and one fire hydrant assembly are needed to construct project numbers 20-SL-59 and 20-WL-139; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2020M-044ES-002 on January 28, 2021, for the acceptance of two additional sanitary sewer manholes and one fire hydrant assembly; and,
WHEREAS, Ordinance No. BL2020-353 provides that amendments to the legislation shall be approved by resolution.
Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. That Ordinance No. BL2020-353 is hereby amended by deleting section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 222 linear feet of existing 15 inch sanitary sewer main (PVC) and easements, and to accept approximately 290 linear feet of new 18 inch sanitary sewer main (PVC), five sanitary sewer manholes, a fire hydrant assembly and easements, for property located at 810 Division Street, as shown on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.
Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution amends Ordinance No. BL2020-353 to accept additional sanitary sewer manholes and a fire hydrant assembly for property located at 810 Division Street. BL2020-353 abandoned 222 linear feet of existing 15-inch sanitary sewer main and easements, and accepted 290 linear feet of new 18-inch sanitary sewer main, three sanitary sewer manholes, and easements for this property. It has since been determined that two additional sanitary sewer manholes and one fire hydrant assembly are needed for the project.
This ordinance has been approved by the planning commission. BL2020-353 provided that future amendments to this ordinance may be approved by resolution.
