WHEREAS, the Metropolitan Government of Nashville and Davidson County, acting through its Department of Parks and Recreation, desires to enter into a license agreement with the State of Tennessee Department of Transportation to use a portion of the Licensed Premises described in Exhibit A attached hereto, to construct and maintain a multi-use pedestrian greenway in Davidson County, Tennessee; and,

WHEREAS, the Board of Parks and Recreation has approved the license agreement; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes Metro to enter into agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental license agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1.                      The license agreement between The Metropolitan Government of Nashville and Davidson County, by and through the Department of Parks and Recreation, and the State of Tennessee, acting through its Commissioner of Transportation, a copy of which is attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

Section 2.                     This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Analysis

 

This resolution approves an agreement between Metro Parks and the Tennessee Department of Transportation (TDOT) to allow Metro to construct a greenway on TDOT right-of-way along Lebanon Pike in Donelson as part of the Stones River greenway. There is no cost to Metro for the use of the TDOT property. The term of the agreement is for ten years, which may be renewed with the consent of the parties. Metro would be liable for any damage to TDOT’s property. The agreement may be terminated at will by TDOT with 60 days’ written notice.

 

This agreement has been approved by the Parks Board and the Planning Commission.
