A Resolution requesting the Tennessee General Assembly to enact a statute to mitigate the negative impacts of blasting operations.

WHEREAS, blasting operations within Nashville and Davidson County often negatively impact constituents by shaking the ground, emitting fumes and dust, and even causing damage to homes; and

WHEREAS, the State of Tennessee has preempted local governments from enacting regulations related to blasting operations; and

WHEREAS, during the last session of the Tennessee General Assembly, Representative Terri Lynn Weaver and Senator Mark Pody introduced HB2877/SB2536 to amend the current state law regarding blasting; and

WHEREAS, this legislation would reduce the maximum allowable ground vibration, as measured in peak particle velocity, for blasting sites, increase fines for those who fail to give notice of blasting operations before the blasting is conducted, increase the minimum insurance coverage during blasting operations, and revise other provisions of the blasting law; and

WHEREAS, due to COVID-19, the Tennessee General Assembly’s legislative session was cut short and this legislation was taken off notice in May of last year; and

WHEREAS, it is in the best interests of the residents of the Metropolitan Government and the state of Tennessee that the Tennessee General Assembly enact legislation similar to HB2877/SB2536 in order to address constituent concerns related to the negative impacts of blasting operations.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan County Council hereby goes on record as requesting the General Assembly to enact a statute regarding blasting to reduce the maximum allowable ground vibration for blasting sites, increase fines for those who fail to give notice of blasting operations, and revise other provisions of the blasting law, similar to HB2877/SB2536 from last legislative session.

Section 2. That the Metropolitan Clerk is directed to send a copy of this Resolution to members of the Davidson County Delegation to the Tennessee General Assembly.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
