WHEREAS, the Metropolitan Government of Nashville and Davidson County ("Metro") conducted a traffic study and determined that a signalized crosswalk was needed at the intersection of 21st Avenue South and Belcourt Avenue; and,

WHEREAS, ECG Belcourt, LLC ("ECG") constructed a mixed use project ("Project") at the intersection of 21st Avenue South and Belcourt Avenue; and,

WHEREAS, the Project will have an impact on the pedestrian and vehicular traffic in the area such that ECG agreed to contribute to the construction and installation of the signalized crosswalk; and,

WHEREAS, it is in the best interest of the Metropolitan Government of Nashville and Davidson County to accept such contribution for the purposes herein specified.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government of Nashville and Davidson County, through the Department of Public Works, is hereby authorized to accept the contribution of twenty-five thousand dollars ($25,000) from ECG Belcourt, LLC, to aid in the construction of a signalized crosswalk at the intersection of 21st Avenue South and Belcourt Avenue, and the contribution shall be deposited in a fund designated by the Director of Finance.

Section 2. That the Department of Public Works shall use the funds for the installation and construction of a signalized crosswalk at the intersection of 21st Avenue South and Belcourt Avenue.

Section 3. That amendments to this legislation shall be approved by Resolution of the Metropolitan Council.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government...
