A resolution requesting the Metropolitan Department of Public Works work with the Tennessee Department of Transportation to place signage within the Metropolitan Government's jurisdiction related to the limitation on the use of an engine compression braking device.

WHEREAS, engine compression braking devices, used by heavy trucks, convert a truck's diesel engine into a power-absorbing air compressor, resulting in a net energy loss to help control the truck's speed; and
WHEREAS, this type of engine brakes makes a distinctive loud sound that can frighten motorists and endanger their safety; and
WHEREAS, the loud sound from these engine brakes has a negative impact on residents within close proximity to a highway; and
WHEREAS, pursuant to Tenn. Code Ann. ? 55-77-117, "[t]ruck tractors and semitrailers, as defined in Tenn. Code Ann. ? 55-8-101, shall not use an engine compression braking device, unless the engine compression braking device is equipped with an operational, approved muffler"; and
WHEREAS, the state law further authorizes any local government to request that the Tennessee Department of Transportation ("TDOT") place signage "to effectuate the purposes of this section within its jurisdiction"; and
WHEREAS, the local government must remit to TDOT the cost of the manufacture and installation of the signs; and
WHEREAS, the Metropolitan Council hereby requests that the Metropolitan Department of Public Works work with the Tennessee Department of Transportation to place signage regarding engine compression braking devices within the jurisdiction of Metropolitan Nashville, specifically along Briley Parkway, in order to notify drivers of the prohibition and to limit the noise caused by the use of this type of brakes.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
