WHEREAS, Ordinance No. BL2020-167, approved March 9, 2020, authorized the abandonment of approximately 110 linear feet of existing eight inch water main, approximately 486 linear feet of existing eight inch sanitary sewer main, approximately 185 linear feet of existing 10 inch sanitary sewer main, approximately 70 linear feet of existing 12 inch sanitary sewer main, three sanitary sewer manholes and easements, including those retained by Substitute Council Bill No. BL2019-35 for Alley Number 337, and the acceptance of approximately 114 linear feet of new eight inch water main (DIP) and relocation if required, approximately 479 linear feet of new 10 inch sanitary sewer main (DIP), five sanitary sewer manholes and easements, for 10 properties located on Patterson Street, State Street and McMillin Street; and,

WHEREAS, the acceptance of an additional fire hydrant, sanitary sewer manhole and easements, are needed to construct Project Nos. 19-WL-117 and 19-SL-156; and,

WHEREAS, the 10 properties located on Patterson Street, State Street and McMillin Street, are now two properties located at 1600 State Street and 300 Bar B Que Aly; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2020M-053ES-002 on September 25, 2020, for the acceptance of said additional fire hydrant assembly, sanitary sewer main and easements and update Map and Parcel information; and,

WHEREAS, Ordinance No. BL2020-167 provides that amendments to the legislation shall be approved by resolution.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1.                     That Ordinance No. BL2020-167 is hereby amended deleting section 1 in its entirety and replacing it with the following:

The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 110 linear feet of existing eight inch water main, approximately 486 linear feet of existing eight inch sanitary sewer main, approximately 185 linear feet of existing 10 inch sanitary sewer main, approximately 70 linear feet of existing 12 inch sanitary sewer main, three sanitary sewer manholes and easements, including those retained by Substitute Council Bill No. BL2019-35 for Alley Number 337, and to accept approximately 114 linear feet of new eight inch water main (DIP) relocating if required, approximately 479 linear feet of new 10 inch sanitary sewer main (DIP), one fire hydrant assembly, six sanitary sewer manholes and easements, for properties located at 1600 State Street and 300 Bar B Que Aly, as shown below and on Exhibit1, which is attached hereto and incorporated by reference:

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.

Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
