An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire permanent and temporary easements through negotiation, condemnation and acceptance, for the Vandiver Force Main and Pump Station projects, for seven properties located on Edenwold Road Connector, Myatt Drive and North Dupont Avenue (Project Nos. 11-SC-109C and 11-SC-109B and Proposal No. 2026M086ES-001).

WHEREAS, the negotiation, condemnation and acceptance of permanent and temporary easements, for seven properties located on Edenwold Road Connector, Myatt Drive and North Dupont Avenue, are needed to construct MWS Project Nos. 11-SC-109C and 11-SC-109B; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2026M086ES-001 on August 28, 2026, for the negotiation, condemnation and acceptance of permanent and temporary easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate, condemn, and accept permanent and temporary easements, for seven properties located on Edenwold Road Connector, Myatt Drive and North Dupont Avenue, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.
Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiation, condemnation and acceptance authorized by this ordinance.
Section 3. All necessary and incidental cost of the temporary and permanent easements herein authorized to be accepted shall be paid from funds authorized from Fund No. 47335 /Capital Plan #139.
Section 4. Amendments to this legislation shall be approved by resolution.
