WHEREAS, the acquisition of a portion of property through negotiation, condemnation or fee simple take, for property located at 1220 Berwick Trail, is needed to construct the Clean Water Nashville Neely's Bend Sewer Pump Station Upgrade project number 11-SC-0112; and,
WHEREAS, the negotiation, condemnation and acceptance of permanent and temporary easements, for property located at 1220 Berwick Trail, is also needed to construct the Clean Water Nashville Neely's Bend Sewer Pump Station Upgrade Project, project number 11-SC-0112; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2024M-157ES-001 on January 3, 2025, to acquire a portion of said property through negotiation, condemnation or fee simple take and for the negotiation, condemnation, and acceptance of permanent and temporary easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to acquire a portion of property through negotiation, condemnation or fee simple take and to negotiate, condemn, and accept permanent and temporary easements, for property located at 1220 Berwick Trail, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference.
