A resolution amending Ordinance BL2024-381, which established certain provisions governing stormwater management practices for the East Bank.

WHEREAS, Ordinance BL2024-381 created an East Bank Stormwater District ("EBSD"); and,
WHEREAS, fair, efficient, and consistent enforcement of stormwater regulations applicable within the EBSD may require the waiver of stormwater regulations and technical guidelines when the interests of the Metropolitan Government and good engineering practice so require; and,
WHEREAS, Ordinance BL2024-381 authorized amendments by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. Ordinance BL2024-381 is hereby amended by adding the following as a new Section 6, with the subsequent sections appropriately renumbered:
The director of the department of water and sewerage services may waive stormwater regulations and technical guidelines otherwise applicable within the East Bank Stormwater District when the interests of the Metropolitan Government and good engineering practice so require. Any waiver of a regulation or guideline issued pursuant to this section and the reasons therefore shall be in writing.
Section 2. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

This resolution amends Ordinance No. BL2024-381, which governs stormwater management practices for the East Bank Stormwater District ("EBSD"). The EBSD comprises the area bounded to the north by Interstate 65, to the south and east by Interstate 24, and to the west by the Cumberland River. The Metropolitan Council may amend Ordinance No. BL2024-381 by resolution.
