A resolution approving a Proposal of the State of Tennessee, Department of Transportation ("TDOT"), to the Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Department of Transportation and Multimodal Infrastructure ("NDOT"), for NDOT to agree to maintain signal and sidewalk upgrades in connection with TDOT's pedestrian road safety construction initiative on State Route 106 (21st Avenue/Broadway) from Pierce Avenue to 19th Avenue South, Federal No. HSIP-106(44), State No. 19045-2247-94, PIN 125526.13 (Proposal No. 2023M-031AG-001).

WHEREAS, the State of Tennessee, Department of Transportation (TDOT), plans to construct a pedestrian road safety project, State Project No. 19045-2247-94, PIN 125526.13, to reduce pedestrian crashes along State Route 106 (21st Avenue/Broadway) from Pierce Avenue to 19th Avenue South, as set forth in the Proposal attached hereto in duplicate as Exhibit A; and,
WHEREAS, the Metropolitan Government of Nashville and Davidson County agrees to cooperate with TDOT as described in said Proposal, attached hereto in duplicate as Exhibit A and incorporated herein by reference, so that said construction can occur; and,
WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b), authorizes the Metropolitan Government of Nashville and Davidson County to approve an agreement with TDOT by resolution; and,
WHEREAS, it is in the best interest of the Metropolitan Government of Nashville and Davidson County that this construction be carried out on State Project No. 19045-2247-94, PIN 125526.13.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1.
