WHEREAS, CSX TRANSPORTATION, INC. ("CSTX") is the owner of a currently unutilized right-of-way, as recorded in Deed Book 426, Page 544, R.O.D.C., TN, on property adjacent to Pumping Station Road (unnumbered), as shown on Exhibit 1; and,
WHEREAS, pursuant to the agreement (the "Agreement") attached and incorporated hereto in substantial form as Exhibit 2, The Metropolitan Government of Nashville and Davidson County, through Metro Water Services ("Agency") proposes to purchase the property for the sum of $507,000 for part of the Omohundro treatment plant expansion; and,
WHEREAS, Resolution No. RS2022-1465 authorized The Metropolitan Government of Nashville and Davidson County to enter agreements with CSX Transportation, Inc. by resolution; and,
WHEREAS, funding for the Project is included in the Capital Budget as No. 21WC0121; and,
WHEREAS, approval of this agreement will benefit the citizens of The Metropolitan Government of Nashville and Davidson County.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Agreement, attached hereto in substantial form as Exhibit 2 and incorporated herein by reference, is hereby approved, and the Directors of Water and Sewerage Services and Public Property Administration are authorized to execute it and such other documents as may be customary and necessary to carry out the transaction contemplated therein.
Section 2. Amendments to this agreement may be approved by resolution of the Metropolitan Council.
