WHEREAS, RS2015-1535 approved an intergovernmental agreement between the State of Tennessee, Department of Transportation ("TDOT"), and the Metropolitan Government, by and through the Nashville Department of Transportation and Multimodal Infrastructure ("NDOT"), for Lebanon Pike sidewalk improvements, PIN 121729.00 (the "Agreement").
WHEREAS, RS2020-512 approved amendment 1 to the Agreement, which replaced in its entirety the language of the Agreement, with the language of amendment 1; and,
WHEREAS, RS2022-1433 approved amendment 2 to the Agreement, which extended the completion date of the project to May 31, 2024; and,
WHEREAS, as set forth in Amendment 3, attached hereto, the parties now desire to amend the Agreement for a third time to replace Exhibit A to the Agreement in its entirety with a new Exhibit A that reflects the change in project costs and to extend the project completion date from May 31, 2024 to June 30, 2026; and,
WHEREAS, it is in the interest of the Metropolitan Government of Nashville and Davidson County that the third amendment be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
