WHEREAS, the Metropolitan Government of Nashville and Davidson County owns certain real property (Parcel ID No. 11803000800; the “Property”); and,

WHEREAS, the City of Berry Hill has requested temporary construction and permanent easements (the “Easements”) on the area designated TCE as shown on Exhibit A for the purposes of performing construction activities and laying, storing, erecting, parking, and/or protecting any equipment, vehicle’s materials, fill, components, parts, and tools associated with the construction of the sidewalk and appurtenant facilities for which these easements are given; and,

WHEREAS, the Board of Education has approved the granting of the easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The granting of the following temporary construction and permanent easements to the City of Berry Hill across said property for the purposes of a sidewalk along the Bransford Road property line to be installed by the City of Berry Hill is hereby approved.

Section 2. The Director of Public Property Administration is authorized to execute and record easements and other such documents as may be necessary to carry out the objective of this ordinance.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
