WHEREAS, on September 27, 2023, James W. Duff was driving a 2019 Nissan Cargo Van owned by US Med-Equip on Briley Parkway north when the van was struck by a MNPD vehicle; and,
WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the property damage claim of Afni, Inc. as subrogee of Great Northern Insurance Company be compromised and settled for $22,635.97, and that this amount be paid from the Self-Insured Liability Fund.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle the property damage claim of Afni, Inc. as Subrogee of Great Northern Insurance Company for the sum of $22,635.97 with said amount to be paid from the Self-Insured Liability Fund.
Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

On September 27, 2023, a Metropolitan Nashville Police Department ("MNPD") officer was driving north on Briley Parkway when he veered out of his lane and struck a US Med-Equip vehicle in the next lane. The US Med-Equip vehicle suffered damage to the driver's side door and rear bumper. The repair estimates exceeded the NADA book value of the cargo van, which was declared a total loss.
