A resolution approving an intergovernmental agreement between the State of Tennessee, Department of Transportation ("TDOT"), and the Metropolitan Government of Nashville and Davidson County, by and through the Nashville Department of Transportation and Multimodal Infrastructure ("NDOT"), for the installation and maintenance of safety improvements on Gallatin Pike, from Liberty Lane to north of Northside Drive. WHEREAS, certain routes in the Metropolitan Government's jurisdiction have been designated as eligible for Highway Safety Improvement Project (HSIP) funds under 23 U.S.C. ? 148; and,
WHEREAS, as set forth in the maintenance agreement attached hereto as "Exhibit A", TDOT desires to assist the Metropolitan Government by installing various signs, snowplowable markers, reflectors, chevrons, thermoplastic white and yellow lines, guardrails, and other safety improvements along Gallatin Pike, from Liberty Lane to north of Northside Drive, in furtherance of the HSIP program ("the Project"); and
WHEREAS, as set forth in the maintenance agreement attached hereto as "Exhibit A", the Metropolitan Government has agreed to cooperate with TDOT during the installation and completion of the Project, be responsible for all maintenance of the completed work of the Project, and pay all costs associated with maintenance of the Project; and,
WHEREAS, Tennessee Code Annotated ? 12-9-104(a)(2)(b) authorizes the Metropolitan Council to approve intergovernmental agreements by resolution; and,
WHEREAS, it is to the benefit of the citizens of the Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
