A resolution approving a Fourth amendment to an intergovernmental agreement between the State of Tennessee, Department of Transportation, and the Metropolitan Government, by and through the Nashville Department of Transportation and Multimodal Infrastructure, for the acceptance of work in connection with the construction of a sidewalk on Lebanon Pike, from McGavock Pike to Old Lebanon Pike. WHEREAS, RS2015-1535 approved an intergovernmental agreement between the State of Tennessee, Department of Transportation ("TDOT"), and the Metropolitan Government, by and through the Nashville Department of Transportation and Multimodal Infrastructure ("NDOT"), for Lebanon Pike sidewalk improvements, PIN 121729.00 (the "Agreement").
WHEREAS, RS2020-512 approved Amendment 1 to the Agreement, which replaced in its entirety the language of the Agreement, with the language of Amendment 1; and,
WHEREAS, RS2022-1433 approved amendment 2 to the Agreement, which extended the completion date of the project to May 31, 2024; and,
WHEREAS, RS2024-421 approved Amendment 3 to the Agreement, which replaced Exhibit A to the Agreement in its entirety with a new Exhibit A that reflected the change in project costs and extended the project completion date from May 31, 2024 to June 30, 2026; and,
WHEREAS, as set forth in Amendment 4, attached hereto, the parties now desire to amend the Agreement for a fourth time to replace Exhibit A to the Agreement in its entirety with a new Exhibit A that reflects a change in project costs; and,
WHEREAS, Tennessee Code Annotated Section 12-9-104(a)(2)(b) authorizes the Metropolitan Council to approve intergovernmental agreements by resolution; and,
WHEREAS, it is in the interest of the Metropolitan Government of Nashville and Davidson County that the fourth amendment be approved.
