A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation ("TDOT"), and the Metropolitan Government of Nashville and Davidson County, by and through the Nashville Department of Transportation and Multimodal Infrastructure (NDOT"), for the repair of existing pavement failures and resurfacing of 2.58 miles of Tusculum Road; State Project No. 19SAR1-S8-021, PIN: 136791.00. WHEREAS, pursuant to the terms of the agreement attached hereto, the Metropolitan Government and TDOT seek to enter into an intergovernmental agreement for the repair of existing pavement failures and resurfacing of 2.58 miles of Tusculum Road, from Nolensville Pk (SR-11) to Blue Hole Rd; and,
WHEREAS, Tennessee Code Annotated ? 12-9-104(a)(2)(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into agreements with the State of Tennessee by resolution; and,
WHEREAS, it is in the best interest of the Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the intergovernmental agreement between the State of Tennessee, Department of Transportation, and the Metropolitan Government of Nashville and Davidson County, by and through the Nashville Department of Transportation and Multimodal Infrastructure, for the repair of existing pavement failures and resurfacing of 2.58 miles of Tusculum Road, attached hereto and incorporated herein by reference, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. That the Metropolitan Government's participation is subject to the availability of funds as determined by the Department of Finance.
