WHEREAS, pursuant to Metropolitan Code of Laws § 5.04.120, the Metropolitan Council can approve donations, exclusive of donations of real estate, by resolution; and

WHEREAS, BNA Woodland OZ Business LLC owns and plans to develop a parcel of property at 408 Woodland Street (the “Property”); and

WHEREAS, as provided in the letter attached as Exhibit A, BNA Woodland OZ Business LLC recognizes the impact that the development will have on the infrastructure in the vicinity of the project and proposes to donate $50,000 to the Metropolitan Government as a contribution towards the cost of construction of nearby infrastructure needs.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That BNA Woodland OZ Business LLC’s proposed donation of $50,000 to the Metropolitan Government of Nashville and Davidson County as a contribution towards the cost of construction of infrastructure needs near 408 Woodland Street, as proposed in Exhibit 1, is approved.

Section 2.  This Resolution shall take effect immediately upon its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

The Council is authorized to approve donations by resolution pursuant to Metropolitan Code of Laws § 5.04.120(B).
