An ordinance authorizing the acquisition of certain right-of-way easements, drainage easements, temporary construction easements and property rights by negotiation or condemnation for use in public projects of the Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Department of Transportation and Multimodal Infrastructure (“NDOT”), for purposes of Highway 100 sidewalk improvements, NDOT Project Number 2023-093. (Proposal No. 2026M-046AG-001).

WHEREAS, NDOT seeks to acquire right-of-way easements, temporary construction easements, and property rights for purposes of its sidewalk improvement project on Highway 100, from Highway 100 west of Collins Road to Highway 100 east of Old Harding Pike, NDOT Project Number 2023-093, Proposal No. 2026M-046AG-001 (“the Project”); and,
WHEREAS, the right-of-way easements, temporary construction easements and property rights associated with the Project are located on the property described in Exhibit 1, attached hereto and incorporated by reference; and,
WHEREAS, the easements and property rights associated with the Project are further described in NDOT’s plans on file for the Project, which are incorporated by reference; and,
WHEREAS, it is in the public interest that right-of-way easements, drainage easements, temporary construction easements, and property rights be acquired by the Metropolitan Government of Nashville and Davidson County, for use in public project referenced herein; and,
WHEREAS, it is in the best interest of the Metropolitan Government that this construction be carried out.
NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
