An ordinance approving Amendment Number 2 to a contract between the Metropolitan Government of Nashville and Davidson County ("Metro") and KCI Technologies, Inc. for Jefferson Street intersection improvements.

WHEREAS, on or about August 13, 2018, Metro entered into a contract with KCI Technologies, Inc. for professional surveying and engineering services for the construction of intersections along Jefferson Street (contract number 431304); and,
WHEREAS, contract number 431304 expired on August 13, 2023; and
WHEREAS, the project has not yet been completed but an open purchase order has allowed KCI Technologies, Inc. to continue working on the project past the contract expiration date; and,
WHEREAS, the parties wish to amend contract number 431304 to extend the contract term to allow for project completion, to increase the value of the contract from $210,000 to $444,307.51, and to remove and replace Exhibits A (pricing information), B (project schedule), and C (project narrative); and,
WHEREAS, the term of the contract, as amended, will exceed a period of sixty months; and,
WHEREAS, section 4.12.160(B) of the Metropolitan Code of Laws calls for Council approval of contracts for supplies or services "with terms exceeding a period of sixty months, either initially or by virtue of amendments, renewals or extensions thereof"; and,
WHEREAS, approval of Amendment Number 2 to contract number 431304 will benefit the citizens of Davidson County.
NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Amendment Number 2 to a contract between the Metropolitan Government of Nashville and Davidson County and KCI Technologies, Inc. (contract number 431304), attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute same.
