A resolution approving a facility encroachment agreement between the Metropolitan Government of Nashville and Davidson County and CSX Transportation, Inc. ("CSX") for the construction, use, and maintenance of a 144-count aerial fiber optic crossing at or near Antioch Subdivision, Milepost 00J-9.75, Latitude N36:03:36, Longitude W86:40:15. WHEREAS, as described in the facility encroachment agreement attached hereto as Exhibit 1 and incorporated by reference herein, the Metropolitan Government, by and through the Department of Information Technology Services (ITS), wishes to construct, use, and maintain one 144-count aerial fiber optic crossing, solely for the transmission of voice communication or other data, via an optical waveguide, through a solid core of glass or plastic fiber material, at or near CSX’s Antioch Subdivision (“the Project”); and,
WHEREAS, BL2005-787 authorized the Metropolitan Council to approve by resolution agreements between the Metropolitan Government and CSX pertaining to permissions for bridge and/or roadway projects in which the Department of Public Works (now known as the Department of Transportation and Multimodal Infrastructure (NDOT)) participates; and,
WHEREAS, NDOT will be participating in the Project in that the Project will provide network redundancy for NDOT traffic cabinets on Murfreesboro Pike and Nolensville Pike, and NDOT will provide lane closure permits for the Project; thus, approval of this agreement by resolution of the Metropolitan Council is appropriate; and,
WHEREAS, it is in the interest of the Metropolitan Government of Nashville and Davidson County that this agreement be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
