A resolution authorizing the Metropolitan Department of Law to compromise and settle the property damage claim of Kevin A. Hopkins against the Metropolitan Government of Nashville and Davidson County in the amount of $49,889.82 with said amount to be paid out of the Self-Insured Liability Fund.

WHEREAS, on January 30, 2025, sewage backed up into the occupied basement apartment owned by Kevin A. Hopkins from a blocked sewer line causing extensive damage. Upon inspection, it was discovered that the main sewer line was blocked causing the backup; and,
WHEREAS, after investigation, the Department of Law believes the settlement listed in Section one is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the property damage claim of Kevin A. Hopkins be compromised and settled for a total of $49,889.82, and that this amount be paid from the Self-Insured Liability Fund.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle the property damage claim of Kevin A. Hopkins for the sum of $49,889.82, with said amount to be paid from the Self-Insured Liability Fund.
Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

On January 30, 2025, sewage backed up into the basement of Kevin Hopkins' rental property at 4704 Richmar Court. Metro Water Services responded and found the Metro sewer main blocked with debris. A vactor crew was requested to clean the sewer main.
Mr. Hopkins paid to have the occupant moved to a short-term rental property. Drywall, wood flooring, carpentry, trim, insulation, fixtures, shower doors, plumbing, tile, and paint were removed and replaced. Other personal items in the basement were damaged beyond repair. Mr. Hopki...
