A resolution approving Amendment 1 to the participation agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Planning Department, and Sojourn Nolensville Apartments, LP, to amend the scope of the agreement.

WHEREAS, Ordinance No. BL2024-628 approved a participation agreement between The Metropolitan Government of Nashville and Davidson County ("Metro") and Sojourn Nolensville Apartments, LP (the "Developer") as part of the Housing Division of the Metropolitan Planning Department's Connecting Housing to Infrastructure Program ("CHIP") for the construction of pedestrian signaling and crossing near the intersection of Nolensville Pike and Taylor Rd to serve the development at 4420 Taylor Rd and the community; and,
WHEREAS, Metro and Developer now wish to amend the scope of the agreement by modifying the pedestrian crossings to be constructed and increasing Metro's level of participation from $178,023.52 to $217,545, as further described in Amendment 1, attached hereto; and,
WHEREAS, Ordinance No. BL2024-628 provides that amendments to the legislation may be approved by resolution; and,
WHEREAS, it is in the best interest of the citizens of the Metropolitan Government of Nashville and Davidson County that Amendment 1 be approved.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Amendment 1 to the participation agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Planning Department, and Sojourn Nolensville Apartments, LP, attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
