WHEREAS, the Metropolitan Government of Nashville and Davidson County, through the Nashville Department of Transportation and Multimodal Infrastructure ("NDOT"), previously entered into Contract #6490604 with LTR Intermediate Holdings, Inc. d/b/a Liberty Tire Recycling ("Liberty") for the collection and disposal of scrap tires with a contract expiration of June 2026 and at a value of $3,000,000; and,
WHEREAS, The Parties wish to amend the contract to extend its term by an additional two years and increase the total contract value to $6 million; and,
WHEREAS, the amendment also clarifies that retailers and those without pre-approval are not eligible for reimbursement for scrap tires; and
WHEREAS, contracts which exceed 60 months must be approved by the Metropolitan Council pursuant to MCL ? 4.12.160; and,
WHEREAS, approval of the contract amendment attached hereto and incorporated herein with Liberty will benefit the citizens of the Metropolitan Government of Nashville and Davidson County.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Amendment Number 1 to a contract between The Metropolitan Government of Nashville and Davidson County and Liberty Tire Recycling contract to extend its term by an additional two years, clarify the specific types of tires eligible for collection and reimbursement, and increase the total contract value to $6 million, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. Amendments to this legislation shall be approved by resolution.
