A resolution approving a construction agreement between the Metropolitan Government of Nashville and Davidson County and CSX Transportation, Inc. ("CSX"), a Virginia corporation with its principal place of business in Jacksonville, Florida, to construct sidewalk improvements adjacent to CSX rail at Alabama Avenue. WHEREAS, as described in the construction agreement attached hereto and incorporated by reference herein, the Metropolitan Government, by and through the Nashville Department of Transportation and Multimodal Infrastructure (NDOT), wishes to construct sidewalk improvements adjacent to CSX rail at Alabama Avenue; and,
WHEREAS, BL2005-787 authorized approval of agreements between the Department of Public Works, now known as NDOT, and CSX by resolution of the Metropolitan Council; and,
WHEREAS, it is in the interest of the Metropolitan Government of Nashville and Davidson County that this agreement be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the construction agreement between CSX Transportation, Inc. and the Metropolitan Government of Nashville and Davidson County, by and through the Nashville Department of Transportation and Multimodal Infrastructure, attached hereto and incorporated by reference therein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. That any amendments, renewals, or extensions of the term of this agreement may be approved by resolution of the Metropolitan Council.
Section 3. That this resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
