A resolution approving an intergovernmental agreement between the Metropolitan Government of Nashville and Davidson County ("Metro"), the Electric Power Board of the Metropolitan Government of Nashville and Davidson County ("NES"), and the United States Marshals Service ("USMS") for access to the 800-MHZ radio communications system for emergency radio service.

WHEREAS, Metro and NES jointly own and operate an emergency radio dispatch and response system utilizing 800-MHZ radio frequencies licensed by the Federal Communications Commission ("the System"); and,
WHEREAS, USMS, a bureau within the United States Department of Justice, performs certain public safety functions; and,
WHEREAS, USMS wishes to have access to the System; and,
WHEREAS, BL2015-1130 approved an intergovernmental agreement granting USMS access to the System that expired on June 30, 2024; and,
WHEREAS, Metro, NES, and the USMS have agreed upon the terms of another intergovernmental agreement, attached hereto and incorporated herein, that grants USMS access to the System and extends the term of the agreement to June 30, 2034; and,
WHEREAS, the Metropolitan Government Emergency Radio Management Committee has approved the USMS' request; and,
WHEREAS, Tennessee Code Annotated Section 12-9-104 provides that intergovernmental agreements may be approved by resolution of the Metropolitan Council.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: That the intergovernmental agreement between the Metropolitan Government of Nashville and Davidson County, the Electric Power Board of the Metropolitan Government of Nashville and Davidson County, and the United States Marshals Service, attached hereto and incorporated herein, is hereby approved and the Mayor is hereby authorized to execute same.
