A resolution approving a renewed intergovernmental license agreement by and between the State of Tennessee, Department of Transportation, and the Metropolitan Government of Nashville and Davidson County ("Metro"), through the Nashville Department of Transportation and Multimodal Infrastructure ("NDOT"), for the benefit of the Metropolitan Nashville Arts Commission, to maintain public art within a State right of way.

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes Metro to enter agreements with the State of Tennessee by resolution; and,
WHEREAS, Resolution RS2014-1265 approved an intergovernmental license agreement between Metro and the State of Tennessee to use a portion of the Korean Veterans Boulevard Roundabout to install and maintain public art; and,
WHEREAS, the Metropolitan Nashville Arts Commission installed and currently maintains public art at the Korean Veterans Boulevard Roundabout which requires renewal of the license agreement to continue maintenance of the public art; and,
WHEREAS, NDOT wishes to enter into a renewed license agreement with the State of Tennessee as the agreement contemplates a right of way; and,
WHEREAS, pursuant to the terms of the of the renewed intergovernmental license agreement with the State of Tennessee, attached hereto as Exhibit A, Metro, by and through NDOT, accepts a license to maintain public art within the State right of way; and,
WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental license agreement be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The renewed intergovernmental license agreement between The Metropolitan Government of Nashville and Davidson Conty and the State of Tennessee, Department of Transportation, attached hereto and incorporated here in as Exhibit A, is hereby approved.
