A resolution authorizing The Metropolitan Government of Nashville and Davidson County, acting by and through Metro Water Services, to enter into two Pipeline Crossing License Agreements with RJ CORMAN RAILROAD COMPANY/NASHVILLE AND WESTERN RAILROAD LINE to construct and maintain pipelines in the railroad right-of-way near 801 12th Avenue North and 1601 Herman Street, in Davidson County, (Project No. 21WC-0049 and Proposal No. 2026M040AG-001).

WHEREAS, The Metropolitan Government of Nashville and Davidson County, through Metro Water Services (“Licensee”) desires to construct and maintain certain pipeline or duct work for the transmission of water, under or over the track(s) and property owned or controlled by RJ CORMAN RAILROAD COMPANY (“Licensor”), pursuant to the terms of the Pipeline Crossing License Agreement (NWR26001), attached hereto in substantial form as Exhibit 1, and,
WHEREAS, The Metropolitan Government of Nashville and Davidson County, through Metro Water Services (“Licensee”) also desires to construct and maintain certain pipeline or duct work for the transmission of water, under or over the track(s) and property owned or controlled by RJ CORMAN RAILROAD COMPANY (“Licensor”), pursuant to the terms of the Pipeline Crossing License Agreement (NWR26002), attached hereto in substantial form as Exhibit 2, and,
WHEREAS, Licensee shall pay Licensor an annual license fee of Four Thousand Dollars for both NWR26001 and NWR26002 payable in advance and due each year in May totaling $8,000.00 upon execution of these contracts. This annual license fee will be adjusted on an annual basis based on the Consumer Price Index (CPI), as provided in the agreement; and,
WHEREAS, Ordinance No. BL2006-1000 authorized The Metropolitan Government of Nashville and Davidson County to enter these types of agreements with Nashville and Western Railroad, now a part of R. J. Corman Railroad company, for water and sewer line construction by resolution; and,
