An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire permanent and temporary easements through negotiation, condemnation and acceptance for the Kennedy Avenue Stormwater Improvement Project for 24 properties located on Kennedy Avenue, Shelton Avenue, Golf Street and Howard Avenue (Project No. 25-SWC-226 and Proposal No. 2025M-034ES-001).

WHEREAS, the negotiation, condemnation and acceptance of permanent and temporary easements for 24 properties located on Kennedy Avenue, Stelton Avenue, Golf Street and Howard Avenue, is needed to construct MWS Project No. 25-SWC-226; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2025M-034ES-001 on April 8, 2024, for the negotiation, condemnation and acceptance of permanent and temporary easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1.                     The Metropolitan Government of Nashville and Davidson County is authorized to negotiate, condemn, and accept permanent and temporary easements for 24 properties located on Kennedy Avenue, Stelton Avenue, Golf Street and Howard Avenue, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2.                     The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiation, condemnation and acceptance authorized by this ordinance.

Section 3.                     Amendments to this legislation shall be approved by resolution.

Section 4.                     This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
